Knowing Your Employment Rights

Hey everyone.

This post is more than a year overdue but I’d still like to publish it anyway because it contains an important account of what happened last year and my life actually had a major turn of events. I’ve been contemplating for awhile whether or not to post this coz firstly, it is rather personal and secondly, I’m afraid writing about it may jeopardise my chances of getting a job if my prospective employer decides to do a social media background check on me lol. Don’t get me wrong, I didn’t do anything illegal. In fact, it’s the complete opposite. I was being righteously indignant.

Introduction – The sack

I rarely discuss about my work life on this space for fear that I might reveal information that is not meant to be shared in public by accident. But I am making this an exception because I think it has some educational value haha, especially for students.

To sum things up, I fell out with my previous employer of 3 and a half years and yes, I was fired from the tuition centre I slogged so long for. The sack came after my outburst at my then bosses for their horrible treatment. I spent 3.5 long torturous years working for people who don’t give two hoots about employee welfare and would constantly push you around like a bully. I was young and in need of money back then (as I stopped taking allowance from my parents), so I remained in the company despite its high turnover rate (both admin staff and teachers alike) as it paid enough for my survival and also had quite flexible working hours.

As a job with no prospects, all they could ever hire are students seeking part-time employment to earn some pocket money. But the bosses seem to be very impatient and intolerant of them (most of whom with no relevant working experience) and always going into frenzy of rage, lashing out at them even at the slightest mistake. They believe that by instilling fear in their employees, they would be more efficient in their work. But little do they know that it lowers people’s morale instead and makes everyone afraid to do the more important tasks (and often leaving them to the seniors to do). Even though they do not physically abuse their staff like this crazy man here, they hurl the most hurtful insults capable of making anyone cry. Granted, there were times when the bosses were nice and would plan company retreats for us, but sadly those happy memories were minimal and didn’t last till the next working day.

To be fair, I gained the trust of the bosses after working for a year and was subsequently promoted to supervisor when I informed them about my plan to delay my studies. The promotion came with an undeniably high pay increment (but here’s the catch: I had to return to the centre whenever they needed me), 7-day annual leave (as opposed to the usual 14 days) but without CPF contribution. I requested for the latter but was turned down because my salary already had CPF included. If I wanted contribution to my CPF account, I had to do it myself coz I was a “self-employed” (erm wtf? Who are you trying to bluff?) At this point in time, I felt a little cheated but still went ahead to fulfill my commitment because it paid well and I needed to save up to pay my Uni fees. There wasn’t even a contract to bind me lol so technically I could leave if I wanted to. But I’m not that irresponsible.

Their attitude towards me began to change a little but being in a management position also meant more work and responsibility. My phone never failed to ring during my off days and most conversations began with lady boss chiding me for mistakes I didn’t make. Initially I took it gracefully but by the third year, I had enough. They really needed to stop treating me like a doormat. I started reasoning with them but my self-defence was regarded as being defiant so our relationship became sour again. My school term started and I reverted to part-time status and could only work 4 days per week including weekends. Gradually, my working hours were shortened by them to cut cost, leaving me with only 2 working days shortly before I was out of the company. Despite that, my workload remained heavy because other less experienced staff wouldn’t want to touch them. Working overtime was also prohibited because they were very reluctant to pay more (not sure why the massive cost-cutting exercise when their business was booming and tuition fees were always on the rise). However with just 2 working days with no time for me to do anything else during operating hours (was always wanted at the front desk as staff couldn’t handle customers’ enquiries alone), it was impossible to complete everything required of me. Thus I had to work overtime til midnight on my what-eventually-became-my-last day at work. I told my ex-colleague, who was there with me for awhile, to explain on my behalf if the lady boss questioned her the next day. I didn’t want to text her because it was already quite late at night.

Then came the last straw. I received a confrontational text from the lady boss the next morning, demanding me not to instruct my staff to tell her that I worked overtime (“Fiona do not get your colleague to tell me what you did for the day”). Apparently that colleague of mine texted her when she left the previous night because she was afraid that she would forget how to tell her if questioned (omg what?). That text came across to me as very brusque and suddenly all the agony and displeasure that I had been bottling up burst from me. In response, I typed 5 long angsty messages to tell her how I felt (no personal insults, just my feelings) and yup, you know it. I was fired. And the news wasn’t even conveyed by her, but by her husband who happened to be the other boss. It turned out that she had also taken a dislike to me (lol no surprise right?) and was probably finding the right time to get rid of me as well. Great, I had given them the opportunity.

To be frank, I don’t feel that offended when I read her messages now. I must’d felt really terrible back then to have such an overreaction. Please understand that I DO NOT usually behave like that!!!

The compensation

Having read a bit of employment law in Poly, I somewhat knew that it is wrong to terminate one’s employment without prior notice. So I sought advice from Ministry Of Manpower (MOM) and true enough, my ex-bosses had gone against the law (they never complied to most anyway). I quote the reply I got from MOM dated 4 March 2013:

Under the Employment Act, both the employee and the employer could exercise its contractual right to terminate the contract of service by giving notice in writing or by paying salary in-lieu of notice to the other party. The notice period shall be in accordance with what is stated in the contract of service. If no such period is previously agreed, the following shall apply:

Length of ServiceNotice Period

less than 26 weeks — 1 day
26 weeks to less than 2 years — 1 week
2 years to less than 5 years — 2 weeks
5 years and above — 4 weeks

If an employer wishes to terminate the employee’s contract of service without giving any notice, he may do so by compensating the employee with salary in-lieu of notice. The employer will also be required to issue a termination letter to the employee.

If you are covered by the Employment Act (ie. not employed in a managerial or executive position) and were given a contractual termination without any advance notice as stated in your contract, you could seek the assistance of the Ministry of Manpower to claim for the notice pay.

Based on the bolded part, I had the right to continue working in the company for the next 2 weeks. But of course, since my ex-bosses hated me so much, they’d rather pay me the salary in-lieu of notice so that they didn’t have to see my face ever again.

The compensation was labelled as “long-service bonus” on the payment voucher can you believe that?!? If I didn’t inform them about this rule, would they even bother to “thank” me for my service? NO. Even at this point of writing, I am still their longest serving admin staff (that’s how bad the turnover rate is). And I dare say I was one of their best employees, or probably the best. I practically slaved away for 3.5 years to get everything in the centre in order alright?

Actually they would la. They owed me a salary of $112 at time of termination. They wrote me a cheque of $120. $8 bonus. 🙂

The complaint to CPF Board

I admit I felt really disgruntled after the incident and all I wanted to do was to get back at them. But I hesitated on lodging a complaint against them to CPF because I knew the seriousness of the consequences they’d face. After all, they had NEVER contributed a single cent to anyone’s CPF account since they started operations in 2004. The arrears owed to all the employees from day 1, coupled with the fine for defaulting on CPF payments, were enough to wipe out most of their earnings (click here to read more about the penalties for defaulting on CPF payments). I didn’t want to be so cruel to resort to that but my boyfriend strongly urged me to get back what I deserved. Think about it: how much had they pocketed just by not contributing to my CPF alone for the past 3 years+ especially during the period of time when I was a full-time staff? It’s A LOT of money.

He is right. These exploitative employers ought to be taught a painful lesson. Most of the admin staff they hired were young female students and they were obviously preying on their naivety and timidity. Unfortunately, I am not one of these girls. And I really hope more students can stand up for themselves.

Hence I proceeded to lodge a complaint through my SingPass (procedures here). It took CPF Board only 3 working days to get back to me. I had to make several trips down to the office itself to be interviewed and produce supporting documents (bank statements to show how much I was paid, proof of employment etc.) but other than that, everything else was settled swiftly by CPF Board (staff that well-handled this case was Ms See Swee Ping who had already left the board). I am also very grateful to one of my ex-colleagues (whose identity remains confidential here) for agreeing to be my witness 🙂

The drama unfolded

It turned out that my ex-bosses never registered their business with CPF Board hence they were able to get away with defaulting on so many CPF payments. Apparently CPF Board and ACRA are separate entities so they will not be able to check which companies fail to make CPF contributions if they are not even registered in the first place. Quite a silly system if you ask me…

Anyway, my ex-bosses (and their partner-in-crime accountant) tried several absurd ways to save their sorry ass. I was extremely angered by their actions and they made me feel that they deserved the harsh penalty. Can you believe that they tried to wiggle their way out of trouble by lying that all the admin staff were freelancers!?!?! Freefreakinglancers. Because freelancers do not get paid CPF. And that’s not it. They even dug out contacts of past employees from as long as 3 years ago, instructing them NOT to reveal that they once worked for the company if CPF ever called them. Existing staff, under the influence of the evil bosses, were also told to persuade past employees whom they are friends with not to reveal the truth! How despicable right?

But I’m sorry. 老天有眼. CPF Board has their ways to investigate and we are definitely NOT freelancers. Furthermore, many past employees I got in touch with were more than willing to testify against them (shows how terrible they were as employers to incur so much wrath). Actually, once a person is proven to have worked for a company before, he would still be entitled to CPF contributions regardless of whether he wants it or not.

Aftermath

The entire process lasted for 3 months and I got my 3.5 years worth of CPF contribution in mid May 2013. And because it was the fault of the employers for failing to contribute, the CPF recipients did not have to pay anything at all, not even the 36% of wage contribution.

I understand that as students, you would naturally want more take-home pay. I wouldn’t mind not having CPF contribution if it was a short-term job. But if you intend to stay in a job for a long time like me, it is better to opt for CPF. Seriously only when you reach my age (a.k.a adulthood) will you comprehend the importance of CPF. Think about the prices of HDB flats nowadays… how to pay?!?! You have to start young to get that kinda money. Unless you’re some rich person la then I bo wei gong.

I know I seem like a very spiteful person here but truth is, if my ex-employers were nice and reasonable, this wouldn’t happen at all even though it’s wrong to default on payments. Believe me when I say that I’m compassionate.

So the bottom line is if you’re going to be a nasty employer, you better make sure you leave no trace of your dirty work ethics behind.

Anyway, the termination was a blessing in disguise. After being trapped in the job for more than 3 years, I could finally explore other career (not the right word to use but meh it sounds nicer haha) options. I had since worked at Love, Bonito, a company which I wanted to work for a long time ago but never had the chance to coz I was supposed to commit my free time to that tuition centre. Now I’m very happy providing tuition and designing services. Life’s really great now and I wouldn’t trade anything in the world for that. Unless, yeah, there’s a job opening with really attractive pay package hehe!

University Sophomore: Year 2 Semester 2

Hope you’re enjoying your 3-month break thus far! I just wanted to get this post up before the course registration period begins on 23 June so that you get a better idea of the course structure of those that I took in the last semester. This is already my fourth instalment and I’m really glad it has guided many of you with your decisions!

Contrary to my last sophomore entry, I didn’t take any NIE modules this semester because I realised I have cleared most of my UEs already (and also all of them clashed with my tuition timing)! I am actually reserving the remaining credits for courses which are relevant to my specialisation track. Speaking of specialisation track, I may be specialising in interdisciplinary concentration to broaden my knowledge since my degree certification would not reflect what my track is. So yeah, while I’m still in school, I thought I should learn the ropes of as many trades as possible to make myself more marketable in the working world (which is just 1.5 years away omg time really flies!) Of course, designing/advertising is still what I like best!

This semester I began life as a THIRD YEAR student in NTU because I had accumulated enough credits. But I’ll refer to myself as a sophomore to avoid confusion. For those who are new here, I was enrolled in 2012 which makes this year my second in NTU. I was one of the few in my cohort who stayed put instead of going on exchange to enjoy ourselves and meet new people in another part of the world. Moreover some seniors were also doing their internships thus the school was relatively quieter and emptier haha. But it was cool – I got the chance to meet and befriend many foreign students who were in NTU for exchange! Yay!

Now, on what I took this semester… I’m afraid this post wouldn’t be of much help to you unless you’re from WKWSCI because I only took 4 courses and all of them are offered by my school. Yes, 4. Was I underloaded? Hahaha.

BUT WAIT! Before you close this window, one of the modules was actually a GER-PE which ANY of you can take so uh-huh, keep reading, won’t you? 😉

1. CS2058 Integrated Marketing Communication (Major PE) 

Lectured by one of the nicest and most prominent professors (Dr Lee Chun Wah) in WKW, it was my only course with a final paper. Having said that, it was also one with the least workload for me with only a term paper and a set of powerpoint slides (with presentation) to submit for grading. All these were done in groups. You wouldn’t need to spend a lot of time on them coz Dr Lee loves information to be concise and straight to the point, and it’s only a 10-page term paper which can be easily done with 4 members in a group.

However both his early-morning lectures (1.5 hours each but they usually end within 45 minutes lol) made it really tough for me to get out of bed. It wouldn’t be that bad if I was still staying at Bukit Batok but I shifted in February to a location so remote that it would take me 1.5 hours to reach school -_- If this was Poly I would have already gotten my first warning letter for poor attendance lol. The number of times I went for his lectures can be counted with 2 hands.

Despite my irregular attendance, I was never worried for my finals coz I realised that whatever he lectured wouldn’t be tested in the end lol (nor were they used at all in our assignments which explains why the number of attendees fell greatly towards the end of the semester). I would say that the finals was a breeze coz the questions were given beforehand and all we had to do was to do our own findings and then vomit them out on our exam script (closed-book). Seems pretty easy but I’m sure getting an A would be tough. Moreover, the exchange students in NTU this semester really went all out!

2. CS4029 Advertising Creativity and Copywriting (Major PE)

My most time-consuming course this semester with an individual graded assignment due every week, or every Thursday to be precise, so I usually had to work very late into the night on Wednesday since ideas only come to me at the very last minute.

Assignments are usually ad mockups (90% of the time) or copy writeups and honestly they are not that difficult to do if you’re a naturally creative person (not implying that I’m one la). The instructor is also very nice and encouraging and he gives the most valid criticisms ever. Even though I suffered from sleep deprivation owing to this module (never failed to sleep at 5am before submission), I still enjoyed it coz there would be prizes awarded to the best designs picked by the endorsers (HPB and Infiniti in this case) which gave me the extra push LOL. Though I didn’t win any of them, the sense of satisfaction when the instructor commended my efforts was enough to make me want to take this course all over again!

I must say that the imparted knowledge from Mr Tim Clark had definitely improved on my advertisement designs over time. Now looking at my previous works I feel deeply embarrassed coz all of them look like crap lol. If you happen to be in his class, be sure to save all his lecture notes as I believe they will come in handy if you intend to pursue a career in the advertising industry.

Actually writing about this makes me want one too -_- Anyway, I’m not gonna lie – this is my most brilliant idea LOL and the idea came to me after drawing like what, 7-8 rough sketches?! Everyone who saw it loved it. (Group project) First part of the storyboard for Health Promotion Board. We were supposed to collaborate with film students from another course to have this shot but due to time constraint, the plan was abandoned. To view the rest of the storyboard, please view my portfolio! 🙂

As you can see, having basic designing skills and designing software is necessary for this course. If you can’t design for nuts… well, it’s not that difficult to learn a trick or two from YouTube 😉

Anyway, the assessment components for this course is 60% individual creative assignments presented in class (some of what I did above), 30% final portfolio submission (pick your best 3 ads and expand one of them into a campaign, making a total of 5 ads to submit) and 10% attendance and participation with NO written exam. There is a weekly 2-hour lecture and 2-hour tutorial, giving you 4 academic units upon completion.

3. CS8070 Creative Visual Experience and Design (GER-PE, LS)

This is for anyone who’s still looking for a GER-PE Liberal Studies course to take.. especially if you’re from ADM coz as the course title suggests, it values design. Or rather, the prof for this course appreciates anything with elaborate design. But he can be really stringent with ADM students as you know, they are more skilled in this aspect. Haha. So if you’re not from ADM but are good at making your report stand out in terms of packaging, this is definitely the course for you.

Yup, this course requires a written report (30% of total marks) on your experience in becoming someone you’re not (for my batch) and no, he doesn’t want it to be in the usual A4, bound in plastic binder kinda report (even though it’s stated on the requirements). He likes it to be in an unconventional form that would blow him away (25% Composition, 25% Creativity, 25% Design, 25% Presentation, mind you). One student even photographed his process and turned his pictorial report into a (thick) flip book OMG OK WAIT WHAAAT. Don’t say the prof la… I myself was also amazed. It must had taken him A LOT of time to do it so he definitely deserves an A. Everyone applauded when the prof showed his work. Good job guy, if you’re reading this (and he’s not from ADM ok. Power la!!!)

Besides the individual report, there was also a group assignment (40% of total marks). Groups were created randomly using the randomizer on Edventure and I was grouped with 4 other girls from other schools. We were given one of the 5 weird topics (Worthy Words) to work on and had to do our presentation in front of a lecture hall of over 100 students using a mic omg. Because everyone in the group was reluctant to present first, I volunteered myself as the first speaker although I have mild stage fright lol gey kiang. Being the first presenting group in a morning lecture, I had to set the tone and be all enthusiastic and chirpy when I was also quite sleepy myself. But THANKFULLY I overcame everything and didn’t choke on my saliva as I spoke hahaha.

Once you’re done with your group assignment (if you’re lucky enough to get to present first), you’re pretty much done with the course but you’d still have to be present for class as attendance takes up 20% of your grades. This course is a 3-hour weekly lecture.

4. CS4088 Advertising Practicum (UE)

Last but not least, a UE which I reckon can be taken by anybody. This is a new course and I was in the pioneer batch and class size was really, really small (barely meeting the minimum number to start a class) probably due to a glitch on STARS planner. Apparently if you try to add that course, the planner would prompt you to fulfill its prerequisite first (which I think is CS4029) when in actual fact, there isn’t any prerequisite at all. Thus I wasn’t registered to the course until I showed up on the first lesson and was manually added by the course coordinator (i.e. the awesome Mr Tim Clark). The course is instructed by a WKWSCI alumni, Alvin, who now heads an advertising firm called The Alchemy Partnership.

With just 8 people (4 locals, 4 exchange students) in the class, we were easily separated into 2 groups of four. In my team were 3 other fun ladies whom I absolutely enjoyed working with. We did so MANY crazy things together in the name of getting a good grade which you can see from here. In fact, I must say that the whole class was a joy to be with la! They made my Fridays the happiest day of my week!! (omg as I’m typing this at 4 in the morning, Alvin texted us through Whatsapp to inform that he misses us HAHA awwww I miss everyone too 😦 )

Throughout the course, we had been on 2 industrial visits to VHQ Media, a post-production, animation and visual effects house and Yellow Box Studios, a sound post production facility. Both were equally enriching and I only hoped there were more of such excursions. Haha.

Of course, we also had hands-on experience as we were given a chance to work on real projects with the guidance of Alchemy’s Account Director. Some of the brands we worked on were Makisan, Ford, Ben and Jerry’s and Red Bull.

Our final individual project was to produce a viral social media campaign for one of given brands. I chose Makisan’s Instagram campaign as it was something I thought was the most feasible (the rest were making videos, or interviewing celebrities O_O I cannot la) and this was what I did:

There isn’t really a lesson structure since it’s a practicum. All you need to know about this course is that it carries 4AU and has a 4-hour “tutorial” every week 🙂

On our final lesson (the week before Good Friday), we met up at one of the country clubs that Alvin frequents 😛 It was at ONE°15 Marina Club at Sentosa.

Awww I miss everyone 😥 It had been an awesome 12 weeks! All of the exchange students have returned home and I sincerely wish them the best in everything they do! Really hope we cross paths one day 🙂

Lady M Confections @ Marina Square

Hey guys!

I wanted to blog about a confectionery that my boyfriend had recommended to me and yup, it’s called Lady M. Apparently it’s a confectionery originated from New York City and I believe the Singapore stores are its only overseas outlets.

We went to the Marina Square branch (the other is at One Fullerton) yesterday after attending my niece’s baby shower and we spotted a long queue at the entrance when we were there! It must be really good, I thought. We waited for about 20 minutes before we finally got a table. With a budget of $30 (which I subsequently increased to $40 lol), we ordered two of their signature cakes and a pot of Earl Grey Tea.

I thought it’s quite important to mention that Lady M serves free iced water! And it comes in this bigger-than-usual good quality plastic cup. To me, offering free iced water is the first step to breeding goodwill among customers but restaurants here rarely do it nowadays.

Our pot of Earl Grey Tea (S$5 without taxes) was enough to serve 2. It was very fragrant, rich and made of very high quality tea leaves. Highly recommended!

Their cakes are layered with “no less than twenty paper-thin handmade crêpes…with ethereal light pastry cream”. In other words, they are America’s kueh lapis 😛

Boyfriend ordered their most popular crepe cake – Vanilla Mille Crepes (S$8/slice without taxes). I tried it and it’s really not bad. The vanilla frosting isn’t too strong and you’d crave for more with every bite.

As a green tea lover, I went with Green Tea Mille Crepes (S$8.50/slice without taxes) which is 70% covered with green tea powder – on top and infused into every layer.

The crepes fall out very easily when sliced, making my plate very messy 😦

I’m not a huge cake fan to begin with, so going to a confectionery didn’t really excite me. But their mille crepes were a refreshing change from the usual layer cakes. I didn’t enjoy the Green Tea Mille Crepes as much as the Vanilla one though because I felt that the former is a little too green tea overdose? It’s not bad at the first bite but you’d get sick of it gradually. However you may love it if you’re a big green tea lover.

We still had some time to burn after having our cakes so we went through their soup menu. Both my boyfriend and I love mushroom soup so we got ourselves a bowl of Vanilla Mushrooms to share. Vanilla?? Interesting. But I’m afraid nothing in there is vanilla at all.

If you’re not in the mood for cakes, they have other food alternative as well! (I actually misread “Fig Tart” as “Big Fart” the very first time I looked at this menu lol)

A bowl of Vanilla Mushroom (S$10 without taxes) is enough for 2 people if you’re not very hungry. But it’s really nice so I regret sharing it with boyfriend.

Soup made of Shimeiji mushrooms, white truffle essence and cheesy croutons. It’s totally meat-free thus it’s also a vegetarian-friendly appetiser. What stood out on my taste bud about this soup is the white truffle essence. It really enhanced the taste of the soup!

The egg york caught us by surprise! We didn’t know there was egg in it since this isn’t mentioned on the menu. Broke the poached egg and mixed it with the soup! It was a brilliant combination!

Happy boy finally satisfied his craving.

Perhaps I’m really not a fan of pastries but I personally feel that their crepe cakes are overrated. I may be wrong since boyfriend loved it so much. Thus I would come back again but obviously not for the cakes. I would for the mushroom soup! It’s honestly one of the best I’ve had and I will definitely not share it with anyone LOL. I would love to try their starters as well probably when I’m ready to splurge again coz they are pretty pricey.

My total damage was S$37.10 including 10% government tax and 7% service charge. Service was satisfactory as the staff were very friendly and welcoming.

I went back again on 18 June as part of a plan for my boyfriend’s birthday celebration and had Red Velvet cake. They seemed to have added new items on their menu coz I didn’t see Red Velvet on my first visit.
